Obama’s recent recess appointment of the head of a powerful new regulatory agency, “so called” because it was not made during an actual recess of Congress, has even been criticized by a political liberal, Yale professor, who dependably takes a very loose view of the Constitution.

Kudos to Iowa Senator Charles Grassley, who writing for all eight Republican members on the Senate Judiciary Committee, has called the Obama administration to task, essentially to show cause as to under what stretch of the Constitution such an action could possible be considered valid. Obama has made appointments without Senate “advice and consent” even though the Senate which is controlled by his own party isn’t in recess by parliamentary standards Democrats have historically used.
