Reading or listening to a variety of conservative blogs and programs many of the commentators went about analyzing the president’s “no tolerance policy” and “stringent” enforcement of the law and the optics it produced as regards illegal immigrant children separated from their law breaking parents. They in essence adopted the Democrat narrative. They also wanted Trump to issue an Obamaesque executive order disregarding law and court decisions and ameliorate the situation. Oh they dutifully call on Congress to write a better law or something, but EO first.
Those conservatives are pleased with Trump for issuing his latest executive order, to be sure many in the belief they are protecting Trump, but they forget their own criticisms of unilateral unconstitutional directives by Obama. It is not OK for Trump and not for Obama.
Some anti-Trumpers (left and right of center) are claiming Trump caved, they are claiming coup as it were. Reading the text of the executive order we are not so sure Trump has gone all Obamaesque on the issue of the executive order or ignoring executive branch limitations. The order is replete with the term “to the extent permitted by law” and with the proviso “subject to the availability of appropriations”
So by our reading, we ask, does it change anything initially? It does not seem to ignore or subvert legal authority in and of itself because — are not by current law and relevant judicial order children to be separated from criminally charged parents (all of this only effects parents and children entering at other than legal points of entry, as in sneaking in)?
The law and relevant court opinion says “Trump” is to not detain children longer than x number of days. They can’t be detained with their parents longer than that either. But processing the “parents” takes more time. That this could turn into catch together, retain together, and release into the interior together with a promise to appear, rather than deport together which is proper given the parents obligation to enter by legal means. Anything other than temporary accommodation for legitimate asylum seekers violates the spirit of sovereignty, border security and immigration laws in general and also violates those immigrants who honor our laws.
Trump’s people say there will not be catch and release as before, that zero tolerance goes on. Legitimate asylum seekers have nothing to fear from Trump’s zero tolerance policy for illegal immigration.
The thing is it is all largely Trumped-up, the problem blown out of proportion and the result of largely Democrat policies.
