SCOTUS MUST HAVE FULL COMPLEMENT BEFORE THE ELECTION

While we are accumulating links and excerpts for a resource page regarding the SCOTUS nomination, news of which will consume so much in this crucial election now that Justice Ginsburg has died, this excerpt from a Ted Cruz commentary on Hannity provides a stark exposition of why Trump and the Senate must move promptly.  We will post more aspects to the SCOTUS process this week and create a page on our page bar for ease of referencing and researching the topic.

(Via Breitbart) – On Friday’s broadcast of the Fox News Channel’s “Hannity,” Senate Judiciary Committee member Sen. Ted Cruz (R-TX) stated that President Donald Trump should nominate Justice Ruth Bader Ginsburg’s successor next week, and that the Senate should confirm a successor before the election. Cruz argued that Democrats plan to challenge the 2020 election, and having a 4-4 court would “risk a constitutional crisis” given that likelihood.

Cruz said, “I believe that the president should, next week, nominate a successor to the court. And I think it is critical that the Senate takes up and confirms that successor before Election Day. There’s going to be enormous pressure from the media. There’s going to be enormous pressure from Democrats to delay filling this vacancy. But this election — this nomination is why Donald Trump was elected. This confirmation is why the voters voted for a Republican majority in the Senate. And I’ll tell you one reason in particular, Sean, why I think it is tremendously important that not only does the nomination happen next week, but that the confirmation happen before Election Day: Because Democrats and Joe Biden have made clear, they intend to challenge this election, they intend to fight the legitimacy of the election. … And we cannot have Election Day come and go with a 4-4 court. A 4-4 court that is equally divided cannot decide anything, and I think we risk a constitutional crisis if we do not have a nine-justice Supreme Court, particularly when there is such a risk of a contested litigation — and a contested election.”

Fox News anchor Harris Faulkner addressed an awkward on-air conversation that occurred one day prior with Newt Gingrich on Thursday, when several co-hosts of “Outnumbered” said George Soros should not be part of a conversation around the cost of riot damage across the U.S.

Senate Democrats, Including Kamala Harris, Call For Investigation Into Durham Probe

Democrats on the Senate Judiciary Committee, including Sen. Kamala Harris, are calling on the Justice Department’s watchdog to investigate whether a probe led by U.S. Attorney John Durham violates Justice Department policy.

Durham, is investigating the origins of the Trump-Russia probe and other intelligence-gathering activities related to Donald Trump and his associates.

“We write to request that you investigate whether U.S. Attorney John Durham’s investigation complies with Department of Justice policies, including policies that protect criminal investigations from political influence,” a group of 10 Democratic senators wrote to Inspector General Michael Horowitz on Thursday.

The Democrats say that statements from Attorney General William Barr and White House officials show that the Durham probe is “being misused for partisan political purposes and undermines the legitimacy of any investigative steps” the prosecutor has taken.

Barr tapped Durham in March 2019 to conduct a broad inquiry into the FBI, CIA and other agencies’ activities related to the Trump campaign. Much of Durham’s work has followed up on a report that Horowitz issued on the FBI’s Crossfire Hurricane investigation on Dec. 9.

That report blasted the FBI for 17 “significant” errors and omissions in applications for surveillance warrants on Trump aide Carter Page.

On Aug. 19, former FBI lawyer Kevin Clinesmith pleaded guilty in the Durham probe to altering an email from the CIA regarding Page.

Barr has provided some insight into areas that Durham is investigating. He has said that Durham is investigating whether the Russian government fed disinformation into the Steele dossier, as well as whether the FBI has been forthcoming about its activities before formally opening Crossfire Hurricane.

Barr has said in interviews that he is “troubled” by what Durham has uncovered so far. He also said last month that there were likely to be “significant” developments in the probe prior to the election.

Barr has dismissed Democrats’ complaints that the investigation is being driven by politics. He has said that Democratic presidential candidate Joe Biden and President Obama are not targets of the investigation.

Committee Democrats also expressed concern about the release of any report from the Durham inquiry.

“It remains unclear what rules and authority permit the public release of a ‘report’ by U.S. Attorney Durham, raising additional concerns about the legitimacy of his appointment and work,” they wrote in the letter to Horowitz.

Barr has suggested that Durham may release a report of the investigation, but he has said that a report is not the goal of the probe.

“We therefore request that your office investigate whether the Durham investigation has operated consistent with Department rules governing the appointment of U.S. Attorneys and the Department’s rules on public statements concerning pending investigations, taking action that may impact an upcoming election, and White House-Department communications concerning pending criminal investigations.”

Biden and Harris, the vice presidential candidate, have not said whether they will allow Durham to continue his investigation if they win in November.

Wray trying mightily to get Biden elected; no surprise there

  • Just wondering, what is China up to??

We have contended all along that Christopher Wray is a “Deep State Denizen”…maybe Trump’s worst and most untrustworthy appointment.

Wray has aggressively attempted to obstruct congressional efforts and Barr’s DOJ investigation to expose the FBI’s extensive wrongdoing in the 2016 election , the Trump campaign, and the Trump presidency.

His testimony before the House Homeland Security committee Thursday to suggest that the Russians are again attempting to meddle in the 2020 presidential election in order to favor Trump’s reelection prospects, is maybe, in our opinion, Wray’s most laughable effort so far.

To us, Wray is a huge disgrace and is the second Director in a row to embarrass the FBI and seriously damaged its reputation and destroyed the confidence the American people have in the Bureau.     dlh

Aurora (CO) Police Stand Down TWICE To Avoid Arresting Violent Felon

“Things were so bad that the Fire Department had to come and rescue McCoy’s girlfriend and their other friend through a window on the second floor using a ladder. And yet the police were told to “stand down” and walk away.

“Aurora Police Deputy Chief Darin Parker said, “We’re trying to get the situation resolved with the least amount of escalation, the least amount of confrontation as we can.” He went on to say that if the officers had responded more aggressively and attempted to take Thompson into custody it could have led to the use of deadly force.”

Asked if he thought the outcome of the Elijah McClain case impacted police strategy, Parker said, “I don’t think it would be inaccurate to say officers are thinking about how they’re handling situations now … what could happen in a situation, and I got to tell you I don’t think that’s necessarily a bad thing. Learning from situations that happened in the past whether it’s our agency or others is not a bad thing.”

Here’s the thing, police have to evaluate every situation for the circumstances, the environment, safety for others, the known players, that is nothing new and they generally do a good job. To assume the police would have automatically gone in guns blazing but for the never realized before political elements heroically brought to our attention by BLM,  or whatever anti-police organization out there,  is a preposterous suggestion from an experienced police supervisor.

And another thing, what if waiting caused or allowed the felon to do worse, murder suicide is not unheard of and in other circumstance quick action can be the saving grace. When circumstance warrant (usually involving threats to others), neutralizing the threat expeditiously is not necessarily bad policing and should not be assumed to be because of politics.

Continuing the Observations on: Justice Delayed Being Justice Denied

Re: Durham’s foot-dragging gets to Hannity

One theory, and I believe that Rush Limbaugh may have mentioned it Wednesday (it is not necessarily a new one):

Durham (and Barr) fear that they will be accused of “politicizing” the DOJ if they reveal, prior to the election, results of their investigation which are damaging to Democrats.
There’s little doubt that that would be charged, both by the Democrats and their ‘enablers/supporters’, the media.

However, there was never doubt that a thorough investigation, properly done, would take time (one might reasonably assume, a year; Durham was named in May, 2019); Mueller’s inquiry into “nothing” took 2 years, but that was extended, ironically, for political reasons.
Anyone who thought that results would be ready so far ahead of time so that it “wouldn’t be labeled “political”, especially by the guilty parties and their media supporters, would not have been naive…they would have been stupid!       dlh
