Supreme Court Weighs State Identity-Fraud Charges Against Immigrant Job Seekers
“The Supreme Court on Wednesday explored whether states can prosecute undocumented immigrants for identity theft when they provide false social security numbers or other information when applying for jobs.
“The justices considered an appeal by the state of Kansas, which obtained convictions against three restaurant workers for using other people’s social security numbers on forms given to their employers. The state Supreme Court threw out the convictions, saying the prosecutions were pre-empted by a provision of federal immigration law that says any information submitted with federal work-authorization forms can’t be used for state law enforcement purposes.”
YOU GOT THAT AMERICA? ILLEGAL IMMIGRANTS CAN USE FALSE SOCIAL SECURITY NUMBERS…FOR AT LEAST SOME PURPOSES! AS A US CITIZEN, CAN YOU? JUST ASK A JUDGE! DLH
It would be ridiculous if states do not have coexistent authority (through statutory law) to combat fraud at the start using information that forms part of an applicants ability to work in the state. R Mall
